This privacy policy (“Privacy Policy”) explains how Elytiq LLC dba TalkStik receives and processes personal information as defined by applicable law from its customers (“Customer Personal Information”). TalkStik provides a personal conversation communication service (referred to herein as “TalkStik Services”, available through mobile applications (including iOS and Android applications) (referred to herein as “App”), to its customers (referred to herein as “Customers,” “Subscribers,” or “you”).
We collect and use the following information to provide our Services as described below:
Account Information. When you set up an account to purchase our Services, you will be required to provide us with personal information such as your name and email address. Your payment information such as credit card information and billing address will be collected by our trusted third-party payment provider. You will also agree to the terms of service that govern your purchase of Services (“Terms of Service”). We use this information to process and fulfill orders, and to send emails to confirm your order status, and provide customer support.
Session recordings. When you use the Services, you will record your conversation on the App. Our Services will create a transcript of the recording and then produce a reflection using a third party AI provider. All recordings of raw voice data are deleted within twenty-four hours of the recording. You may delete the transcript at any time.
Marketing. We may collect Your personal information to provide you with free of charge marketing related materials. If you do not wish to receive such marketing materials from us (or any other company related to TalkStik), then click the “unsubscribe” button on the bottom of the email.
Device, Usage, and Diagnostic Information. When you use the TalkStik mobile app, we and our service providers automatically collect information that does not identify you by name but is associated with your app installation or account: your Internet Protocol (IP) address; your device type and operating-system version; the app version; general in-app activity; and diagnostic data such as crash reports and performance data (which include device model and operating-system details). We use this to operate, secure, troubleshoot, and improve the Service, and we assign your account an identifier so the app can authenticate you across sessions. Your IP address is handled in two ways. In our own account and consent records, we store it only in a one-way, hashed form. Separately-to route traffic, establish the direct (peer-to-peer) audio connection between participants, prevent abuse, and diagnose crashes-your IP address is processed, and may be temporarily retained, by our hosting, network, and diagnostics service providers.
Purchases and Subscriptions. If you buy a subscription, our subscription-management and payments provider (together with the Apple App Store or Google Play) processes purchase and receipt information and a store-provided device identifier (such as Apple's Vendor Identifier / IDFV) to complete, restore, and manage your subscription. We do not use this information for advertising.
Crash Diagnostics and Subscription Management. Crash and performance diagnostics (which keep the app reliable and secure) and subscription management (which provides paid features) are carried out by service providers acting on our behalf and are part of how we operate, secure, maintain the quality of, and support the app. They are not features that can be turned off within the app, and these providers are contractually limited to processing your information only for these purposes.
Collection and Use of Aggregate Information. We may use aggregate information (not containing personal information) to analyze trends, administer the App, track users’ movements, and gather broad demographic information on aggregate use.
Service Providers. TalkStik shares personal information with trusted Service Providers for the business purposes of providing the following types of services: webApp hosting, audio to text transcription, customer support, and payment processing.
Third-Party AI Providers. TalkStik uses third-party AI services to power its analysis features. By using the Service, you acknowledge that portions of your transcribed conversation may be transmitted to these third-party providers for the purpose of generating analysis. These transmissions are subject to the providers’ own privacy and data processing terms.
Compliance with Laws. We may disclose your personal information to a third party if (a) We reasonably believe that such disclosure is necessary to comply with any applicable law, regulation, legal process or governmental request, or (b) to protect the security or integrity of the Services from harm or illegal activities.
Business Transfers. We may share or transfer your personal information in connection with, or during the negotiations of, any merger, sale of TalkStik, its assets, financing, or acquisition of all or a portion of the business to another entity related to TalkStik.
Your Account. You may update, correct, or delete information about you at any time by logging into your online account and modifying Your information or by emailing Us at privacy@talkstik.com.
Retention Policy. We will retain Customer Personal Information connected to your account as long as necessary to provide the Services unless a longer period is required or permitted for legal or compliance purposes. We will delete raw audio recording data within twenty-four hours of the recording.
Do Not Track. Some browsers offer a “do not track” (“DNT”) option. We do not respond to DNT signals.
U.S. States Privacy Notice. For additional information and rights available to consumers in certain states, see the U.S. States Privacy Notice here.
We employ industry standard technological measures that are reasonably designed to help protect your personal information from loss, unauthorized access, disclosure, alteration, or destruction. TalkStik may use, without limitation, firewalls, password protection, secure socket layer, and other security measures to help prevent unauthorized access to Your personal information. While we take reasonable efforts to guard personal information, no security system is impenetrable. We advise to always secure your own devices by appropriate security measures.
